The Company Kuwait Airways (KU: IATA, KAC: ICAO) is the official
national carrier of the State of Kuwait. Established in 1953 as a private
company, the airline was initially 50 per cent owned by the Kuwaiti government.
In 1962, the government assumed 100 per cent ownership, making it the longest
serving, official state carrier operating from the Arabian Gulf Region.
Kuwait Airways employs over 4,800 people, and the head
office is in the heart of Kuwait City, close to Kuwait International Airport
(KWI). The airline currently provides regular scheduled services to 36
international destinations in the Far East, Middle East, Europe and North
America.
Kuwait Airways’ fleet
of 23 aircraft currently consists of 5 x B777-300ER, 7 x A320-200CEO (completed
delivery Q2 2015), 5 x A330s (completed delivery Q4 2015), 4 x A340-300, 2 x
Boeing 777-200, and 1 x Boeing 747-400. Kuwait Airways will boast the youngest
commercial airline fleet in the world.
Kuwait Airways is actively recruiting for the role of Legal
Director.
The Role
In this role, you will direct the activities of the Legal
Affairs Department, which is engaged in general legal activities such as the
tendering and administration of contracts, and KAC insurance activities. The
responsibilities of this role will include advising executive management on
corporate legal rights and obligations, participating in contract negotiations
to ensure proper documentation, contract and agreement accuracy, arranging for
insuring all corporate properties, assets, liabilities and personnel, and examining
specific internal and external problems and providing the appropriate legal
advice.
You are to develop KAC policies on contract and insurance procedures
and identify types of coverage for executive management approval. You are to
supervise and direct the preparation of contracts and insurance policies,
negotiation of claims and provisions of other legal services.
You are to provide management with advice on the formulation of
contractual and insurance terms and conditions, as applicable, for
international as well as local contracting and insurance activities such as
international law and arbitration.
You are to provide department directors with advice on contracts,
insurance and other legal matters, including the interpretation of KAC policies.
This will include reviewing drafts of contract agreement(s) to ensure
compliance with related Kuwaiti and international regulations, and KAC legal
rights.
You will supervise, check and prepare call for tenders, contracts, amendments,
etc., and personally attend or delegate subordinates to attend Tender Committee
meetings.
You are to advice on all matters involving litigation, including but
not limited to reviewing and approving case briefs, participating in legal and
quasi-legal proceedings and supervising legal representation in all aspects of
litigation.
You are to exercise general supervision over insurance activities to
ensure coverage of all KAC risks and liabilities, including the participation
in premium and contract provisions with local insurance and re-insurance
companies, inspecting important accidents and recommending claim settlements on
ex-gratia basis.
You are to serve as a member and participate in the activities of the
Disciplinary Council, Tenders Committee, Personnel Committee, Aircraft
Purchasing Committee and other committees to provide legal advice as required.
You are to carry out other similar or related duties such as reviewing
and signing all correspondence with Government authorities in order to obtain
their approval or answer queries regarding KAC contractual and other legal
activities, preparing and controlling department budget, selecting outside
corporate lawyers and approving their appointment and conditions of service,
keeping up-to-date with local and international laws and conventions related to
airline business and carriers liability; advise general management of the
implications of new legal developments to KAC operations, etc.
Requirement:
Law Degree from a recognized and reputable
university.
Fifteen (15) years' of experience
in private law practice, of which at least 6 years are in a senior supervisory
position in legal and insurance activities preferably within the airline industry.
